Terms of Service
Effective date: September 15, 2026
These Terms of Service govern your use of the Kestrel Outbound website and your interactions with Abdul Sami Uddin, operating under the trading name Kestrel Outbound (“Kestrel,” “we,” “us,” or “our”).
These website Terms do not replace a separate service agreement, proposal, statement of work, or other written agreement entered into between Kestrel and a client. If there is a conflict concerning paid services, the applicable signed or accepted client agreement will control.
1. About Kestrel
Kestrel Outbound is a trading name operated by Abdul Sami Uddin.
Kestrel Outbound provides B2B outbound sales and appointment-setting services, including activities such as market definition, prospect research and filtering, outreach messaging, campaign execution, qualification, meeting booking, confirmation, follow-up, and reporting.
The exact scope of work provided to a client is determined by the applicable proposal or service agreement.
2. Website Use
You may use this website for legitimate business and informational purposes.
You must not misuse the website, interfere with its operation, attempt unauthorized access to systems or information, introduce malicious code, scrape or reproduce substantial portions of the website without authorization, or use the website in violation of applicable law.
3. Kestrel Fit Calls
Booking a Kestrel Fit Call does not create a client relationship or obligate either party to purchase or provide services.
Information discussed during an introductory call is intended to help both parties determine whether working together makes sense.
4. No Guarantee of Results
Outbound performance depends on many factors outside Kestrel's control, including the client's offer, pricing, positioning, reputation, market conditions, target audience, sales process, responsiveness, deliverability conditions, and prospect behavior.
Unless expressly stated in a separate written agreement, Kestrel does not guarantee a specific number of replies, qualified opportunities, meetings, customers, revenue, or other commercial results.
Examples, diagrams, metrics, dashboards, reports, or campaign figures displayed on the website for explanatory purposes are illustrative and should not be interpreted as historical client results, guarantees, or projections.
5. Client Responsibilities
Where you engage Kestrel for services, you may be responsible for providing accurate information about your business and offer, supplying requested materials and access, responding to opportunities in a reasonable time, maintaining the ability to deliver services you sell, and complying with obligations allocated to you under the applicable client agreement.
Detailed responsibilities will be established in that agreement rather than these general website Terms.
6. Third-Party Services
Our website and services may rely on or link to third-party services, including scheduling, email, hosting, prospecting, analytics, communication, and other business tools.
Kestrel does not control those third parties and is not responsible for their independent availability, policies, security, content, or practices.
7. Intellectual Property
Unless otherwise stated, the Kestrel Outbound name, branding, website design, written content, graphics, processes presented on the website, and other original website materials belong to Kestrel or are used with appropriate permission.
You may view and use the website for normal business and informational purposes, but you may not copy, republish, sell, distribute, or commercially exploit substantial portions of our proprietary material without permission.
Client ownership, licenses, campaign materials, prospect data, and deliverables created during an engagement will be governed by the applicable client agreement.
8. Confidentiality
Information submitted through a website inquiry or discussed during an introductory conversation will be handled with reasonable care.
Formal confidentiality obligations relating to a client engagement should be established in the applicable service agreement or nondisclosure agreement where appropriate.
You should not submit highly sensitive information through the website or booking form unless specifically requested through an appropriate channel.
9. Website Information
We aim to keep the website accurate and useful, but information may occasionally be incomplete, outdated, or contain errors.
Website content is provided for general business information and does not constitute legal, financial, tax, or other regulated professional advice.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Kestrel will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from your use of, or inability to use, this website.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
Liability relating to paid client services should be governed by the applicable client agreement.
11. Indemnification
To the extent permitted by applicable law, you agree not to hold Kestrel responsible for claims resulting from your unlawful misuse of the website or violation of these Terms.
Any broader indemnification obligations relating to paid services must be established separately in the applicable client agreement.
12. Changes
We may update these Terms when our website, services, or legal requirements change. Updated Terms will be posted on this website with a revised effective date.
13. Governing Law
These Terms are governed by the laws of Pakistan, without prejudice to any mandatory rights or protections that may apply under the laws of another jurisdiction.
